We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.
SECTION 4 - SHOPIFY
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.
Payment:
If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.
PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 5 - THIRD-PARTY SERVICES
In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

- Order Acceptance and Cancellation.
You agree that your order is an offer to buy, under these Terms, all products and services listed in your order. All orders must be accepted by us or we will not be obligated to sell the products or services to you. We may choose not to accept orders at our sole discretion, even after we send you a confirmation email with your order number and details of the items you have ordered.
- Prices and Payment Terms.

(a) YOU AND EASE LIVING ARE AGREEING TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY, OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM. OTHER RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT MAY ALSO BE UNAVAILABLE OR MAY BE LIMITED IN ARBITRATION.
(b) ANY CLAIM, DISPUTE OR CONTROVERSY (WHETHER IN CONTRACT, TORT OR OTHERWISE, WHETHER PRE-EXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, CONSUMER PROTECTION, COMMON LAW, INTENTIONAL TORT, INJUNCTIVE AND EQUITABLE CLAIMS) BETWEEN YOU AND US ARISING FROM OR RELATING IN ANY WAY TO YOUR PURCHASE OF PRODUCTS OR SERVICES THROUGH THE SITE, WILL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION.

(d) The arbitrator will have exclusive authority to resolve any dispute relating to arbitrability and/or enforceability of this arbitration provision, including any unconscionability challenge or any other challenge that the arbitration provision or the agreement is void, voidable, or otherwise invalid. The arbitrator will be empowered to grant whatever relief would be available in court under law or in equity. Any award of the arbitrator(s) will be final and binding on each of the parties, and may be entered as a judgment in any court of competent jurisdiction.
(e) You may elect to pursue your claim in small-claims court in Oakland County, Michigan, rather than arbitration if you provide us with written notice of your intention to do so within 60 days of your purchase. The arbitration or small-claims court proceeding will be limited solely to your individual dispute or controversy.
(f) You agree to an arbitration on an individual basis. In any dispute, NEITHER YOU NOR EASE LIVING WILL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER CUSTOMERS IN COURT OR IN ARBITRATION OR OTHERWISE PARTICIPATE IN ANY CLAIM AS A CLASS REPRESENTATIVE, CLASS MEMBER OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. The arbitral tribunal may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding. The arbitral tribunal has no power to consider the enforceability of this class arbitration waiver and any challenge to the class arbitration waiver may only be raised in a court of competent jurisdiction.
If any provision of this arbitration agreement is found unenforceable, the unenforceable provision will be severed and the remaining arbitration terms will be enforced.
- Assignment.
You will not assign any of your rights or delegate any of your obligations under these Terms without our prior written consent. Any purported assignment or delegation in violation of this Section 12 is null and void. No assignment or delegation relieves you of any of your obligations under these Terms.
- No Waivers.
The failure by us to enforce any right or provision of these Terms will not constitute a waiver of future enforcement of that right or provision. The waiver of any right or provision will be effective only if in writing and signed by a duly authorized representative of Ease Living.
- No Third-Party Beneficiaries.
These Terms do not and are not intended to confer any rights or remedies upon any person other than you.
- Notices.
(a) To You. We may provide any notice to you under these Terms by: (i) sending a message to the email address you provide or (ii) by posting to the Website. Notices sent by email will be effective when we send the email and notices we provide by posting will be effective upon posting. It is your responsibility to keep your email address current.
(b) To Us. To give us notice under these Terms, you must contact us as follows: (i) by personal delivery, overnight courier, or registered or certified mail to 32060 Waltham Drive, Beverly Hills, MI 48025, Attn: CEO. We may update the address for notices to us by posting a notice on the Website. Notices provided by personal delivery will be effective immediately. Notices provided by overnight courier will be effective one business day after they are sent. Notices provided by registered or certified mail will be effective three business days after they are sent.
- Severability.
If any provision of these Terms is invalid, illegal, void or unenforceable, then that provision will be deemed severed from these Terms and will not affect the validity or enforceability of the remaining provisions of these Terms.
- Entire Agreement.
Our order confirmation, these Terms, our Website Terms of Use, our Privacy Policy and all other policies, terms and conditions referenced herein and therein, will be deemed the final and integrated agreement between you and us on the matters contained in these Terms.
- Customs Duties and Taxes:
Ease Living currently ships via US Postal Service, UPS Worldwide and DHL. Buyer may select an alternative freight forwarder or carrier, in which case we will use commercially reasonable efforts to ship the order using that freight forwarder or carrier, as the case may be.
International customers are responsible for any government-imposed customs, taxes, and levies for the relevant product purchase.
Ease Living does not refund any fees or costs for any international order confiscated by customs or another government agency.
We do our best to label all boxes and customs forms with the text "Medical Supplies", which are usually duty-free. However, customs officers, who determine which Medical Supplies are duty-free and which are not, have full authority to charge you, the buyer, for the custom duty and taxes.
Due to the complex and ever-changing customs policies, which vary widely from country to country, we cannot guarantee that your country permits importation for the items you ordered.
Therefore, it is important that you first become familiar with your country’s customs laws and contact your local customs office or tax authority for information specific to the products before placing an order with Ease Living.
By placing the order from easeliving.com, you are solely responsible for and accept, agree, and assume any and all risks, charges, and a cost associated with the shipment of your order.
Orders that are seized or delayed by customs are exclusively the customer’s responsibility. Ease Living is not responsible or accountable for any taxes, duties, tariffs or any quarantine fees or package warehousing fees assessed by your local customs office.
Unfortunately, some items are not eligible for international shipping due to size and customs restrictions, as specified on the relevant website product page.
B. RETURN POLICY

Products must be returned within 30 days of receipt
Products must be returned with their original packaging unless different arrangements are made in advance.
Bathroom and incontinence products can not be returned for health and hygiene reasons.
You will be responsible for paying for your own shipping costs for returning your item. Shipping costs paid are non-refundable.
Refund will be issued after the item has been received and inspected.
- ORDER REFUSAL POLICY
If a package is refused at the time of delivery, the customer will be responsible for round-trip shipping costs incurred by Ease Living. Once the package is back in our warehouse, subject to inspection, we will issue a credit to the original form of payment after deducting any applicable return shipping charges. The return shipping charge will apply even if you were originally not charged any shipping due to a free shipping promotion. This policy does not apply to packages that appear to have been damaged during shipping.
International Package Refusal Policy:
If an international package is refused during delivery, the customer will be responsible for all VAT Fees, import fees, Return shipping costs and Abandonment fees. These fees will be deducted from your refund. If these fees are greater than the product(s) price, Ease Living may bill you for the balance.
- CANCELLATION POLICY
At Ease Living, we believe in providing absolute customer satisfaction and pleasant shopping experiences. Most of the items are processed for shipment through our system within a few minutes of placing the order. You can cancel your order before the product has been processed for shipment. Once the shipment is processed for departure, returns and refunds will be processed in accordance with Ease Living’s return policies..
If you wish to cancel your order, kindly contact our Customer Service department at 866-452-0809 email support@easeliving.com. The refund on canceled orders will be credited back to the original method of payment used. Coupons or any special offer applied on the order will not be credited back. Ease Living reserves the right to cancel any order. The orders can't be changed or modified once processed for shipment.
- COUPON POLICY AND DISCLAIMER
Ease Living reserves the right to accept, decline or limit the use of any coupon(s) or promotional codes on a single item or an entire purchase. An order with coupon or promotional code can be canceled by Ease Living due to unforeseen circumstances, technical errors or purchases deemed to be fraudulent. Additionally, prices and coupon offers are subject to change without notice.
- Coupon can be applied only once per household.
- Expired coupons will not be accepted.
- Some products may not qualify for discount offers due to manufacturer price restrictions, size and weight of items, or due to previously applied savings or discounts.
- Coupons and free shipping promotions are valid only on orders with a shipping and billing address found in the continental U.S., unless otherwise stated.
- Coupons, promotional codes and special shipping offers do not apply to international orders.
- Coupons are void where prohibited, taxed, or otherwise restricted.
- Coupons can’t be used by any other business or retailer for product reselling purposes.
- Coupon codes and promotional offers may not be published elsewhere without written permission from Ease Living.
